EZI PAY PLAN Terms and Conditions. (WDTC1)
All WEBDOCTOR INTERNATIONAL services are provided on a minimum 24 month non-negotiable agreement. WEBSITES: All website service plans are to carry a nominal deposit to be negotiated by the client and the WEBDOCTOR agent, if an amount cannot be agreed upon the deposit will be the amount of 4 monthly payments from your selected plan, until the deposit is recieved NO WORK shall commence. HARDWARE: All hardware shall remain the property of WEBDOCTOR INTERNATIONAL until after a 36 month period has been serviced, then the items shall become the property of the customer, the ITEMS will be covered by warranty for the entire period in which the customer continues to pay the monthly instalments as agreed in the initial contract. Factory warranty WILL cover hardware for manufacturers defects causing malfunction occurring whilst under normal operation. Warranty will NOT cover hardware for a) normal wear and tear b) neglect or misuse c) acts of God d) wilful or accidental damages. If an item needs repair outside of warranty terms, repairs will not be serviced under warranty terms nor will ANY discounts be applied to parts or labour needed to perform and complete repairs, a minimum service fee of $99.00 will also apply in such circumstances, If the item needs to transported from a property and returned by WEBDOCTOR INTERNATIONAL, a $99.00 transportation fee shall apply. [Definitions] a) normal wear and tear includes everyday use combined with the failure to have the hardware serviced regularly, minimum service time is once per twelve weeks, it is the customers responsibility to schedule an appointment to have the hardware maintained by a WEBDOCTOR INTERNATIONAL technician, scheduled services ensure hardware is adequately checked for possible cause of malfunction. b) neglect or misuse shall be defined by failure to operate hardware in such a manner where it causes failure of normal operation or reduces effectiveness or efficiency of hardware, such instances may include dust collecting in the interior and on the exterior of the hardware resulting in restriction to air flow and causing overheating to components which may result in permanent damage. c) acts of God shall be defined by any such event caused by nature including flood, fire, earthquake, storms (cyclone, hurricane, electrical, rain, wind) excessive heat or cold due to the elements. d) wilful or accidental damage shall be defined in the event where the hardware is damaged due to a person or persons causing any type of damage to hardware by act of vandalism, misuse, neglect or accidental damage, such damage could be defined as impact, puncture, spillages, damages caused by chemicals, fumes, smoke, water or liquids, short circuits, fusion, power surge or electricity supply faults. PAYMENTS: where a scheduled payment is dishonoured there will be a notification made immediately, allowing the situation to be rectified within five (5) business days. Failure to correct this within five (5) business days will result in suspension of services and another notification being sent allowing a further ten (10) business days to correct the situation, Failure to comply will result in automatic cancellation of services and litigation will commence to recover the full amount of the remainder of he contract agreement period. After the allocated suspension period, In the case where hardware is involved and in any event; the case be referred to a debt collection agency for further processing and recovery, debt collection fees may also apply. Upon full recovery of debt the services shall be resumed until the end of the agreed contract period, if the period has expired in the case of a website, the website will remain the property of WEBDOCTOR INTERNATIONAL until such time when the client has purchased the website at the agreed amount as stipulated in form WDA1 (section1d) and will remain unpublished or suspended until such time when the client can fulfil its obligations as stipulated in all sections of form WDA1. SCHEDULED SERVICES: Each EZI PAY PLAN is supplied with time from one of our WEBDOCTOR INTERNATIONAL service technicians, this time is divided into monthly allocated intervals and may be used to provide any services we offer, the time is not transferable and will not roll over to the next month, nor can it be accumulated be broken apart or used in advance. If the time is used for a scheduled service the service may take longer than your allocated amount, in such cases the technician will issue an invoice which must be paid within five (5) business days, we accept Cash or Cheque for this purpose, failure to comply with this will be a breach of your agreement and incur a penalty of a 50% surcharge on the invoice. If the matter is not rectified within a further ten (10) business days it will be escalated to a serious matter and WEBDOCTOR ITERNATIONAL shall reserve the right to refer the matter to a debt collection agency for recovery of the full amount owing over the duration of the contract agreement.
